Abstract

The marriage agreement regarding the separation of assets obtained between them both before and during the marriage takes place in order to minimize in the event that the goal is not achieved in the marriage. There are times when a prospective married couple makes a marriage agreement before stepping into marriage. The purpose of this thesis is to: find out the comparison of the marriage agreement law between the Civil Code and the UUP, to find out the legal consequences of marriage assets from the marriage agreement. This research is a library research with a normative juridical research approach. The main data source for this research is secondary data in the form of Civil Law Law and Law No. 1 of 1974 on Marriage. The results of the conclusion of the thesis are that the legal provisions of the marriage agreement are regulated in the Civil Code Article 139 to Article 154 and are regulated in Article 29 of the Company Law. The marriage agreement must be made with a notary and conducted before marriage. marrying together with the results and negating the sharing of assets or separation of assets. The legal consequence is a binding agreement, not detrimental to the third party, legalized by the marriage ceremony employee. Based on the results of this thesis, it is hoped that it will become material for information and input for students, academics, practitioners, and all those who need it within the Faculty of Law, University of Bhayangkara Surabaya.
