Abstract

Hadirnya perubahan paradigma dan konsep terkait keputusan tata usaha negara dari yang semula fiktif negatif sesuai ketentuan Pasal 3 UU PTUN, menjadi keputusan fiktif positif sebagaimana diatur dalam Pasal 53 UU AP mencerminkan adanya spirit peningkatan kualitas pelayanan publik sebagai bagian dari reformasi birokrasi bagi aparatur pemerintahan dalam menjalankan tugas dan fungsinya. Pada perkembangannya, PTUN tidak hanya menguji terhadap sengketa kepegawaian, namun juga berperan aktif memberikan perlindungan terhadap rakyat apabila terdapat tindakan dan/atau keputusan yang dikeluarkan oleh pejabat pemerintah dinilai merugikan kepentingan konstitusional (cacat yuridis dan/atau maladministrasi). Melalui semangat perubahan dalam pasal 53 UU AP jo Perma No 8 Tahun 2017 tentang konsep Keputusan Fiktif Positif, menjadikan pemerintah bersikap responsif dan komunikatif ketika melakukan pelayanan publik. Artinya apabila 10 hari kerja atau batas waktu tertentu sesuai amanat perundang-undangan permohonan yang diajukan oleh warga masyarakat/subjek hukum telah diterima dan berkas lengkap oleh badan dan/atau pejabat pemerintahan, namun badan dan/atau pejabat pemerintahan tidak menetapkan dan/atau memberikan keputusan dan/atau tindakan, maka permohonan tersebut dianggap dikabulkan secara hukum. Dengan demikian, diam/lambatnya pemerintah dalam melakukan pelayanan publik, berdasarkan UU AP menjadikan tindakan tersebut sebagai objek sengketa pemerintahan yang dapat dipersoalkan melalui PTUN agar badan dan/atau pejabat pemerintahan melaksanakan dan/atau memberikan permohonan yang dimohonkan tersebutThe emerge of the fictive positive decision as mention in Act No 30/2014 as previously known as the negative decision in article 3 Administrative Court Act (Act No 5/1986 jo 9/2004 jo 51/2009) reflecting the spirit of bureaucratic reform in the frame of public service (bestuurzorg). In the spirit of changes, nowadays in the article 53 Government Administration Act jo Supreme Court Regulation No 8/ 2017 about fictive positive decision concept, enhance the public officer/government to be transparent and communicative (perceptive) in order to the public service. It means, if 10 work day or the due date was selected in law provision about proposal which has been sent by applicant and the document has accepted fully by public officer or government and the public officer or government not immediately answer the proposal, so the proposal automatically will be accepted legally. Thus, the stagnant (silent) of the public officer or the government in order to public service duty, referring to Administrative Government Act make it becomes part of the government dispute and incompetence in assessing by the administrative court, so that the final decree from the administrative court can be forcing to the public officer or government to do the command and take the executive action or the executive decision to issued the proposal which has applied before for the applicant interest.
