Abstract

This thesis purpose is to analyze what causes the high number of faked documents regarding export activities based on the primary law which is in Clause 103a of the Constitution number 10 year 1995 which has been changed into Constitution number 17 year 2006 regarding customs. As for the focus of the matter, it is directed to the self-assessment system that lets the faking of the documents concerning customs export activities happen. The method that is being used in this study is normative juridical statute approach in export activities that apply, along with how the norms that are stated in the KUHP that later will be combined with alternative approach by using a case approach that is in line with the crime of the faking of export-activities-related documents under the constitution regarding customs. This study came forward to a conclusion that the self-assessment system is indeed beneficial in supporting the speed of the process in helping the export commodities in Indonesia to compete better as a part of the world market. On the other hand, the said self-assessment system doesn’t give any control function towards the authenticity of the contents of the documents especially the ones concerning dangerous goods export commodities.
