Abstract

In the case of online loan application services, many people have complained about problems regarding the dissemination of personal data by online loan providers without notice and without permission from the owner.In this regard, it is important to study the legal protection of borrowers' personal data in online loan application services, and sanctions for personal data violations. The purpose of this paper is to examine legal liability for debtors for the maturity of online loan payments. The method used in this paper is a normative legal method with a statutory approach.The results of the study show that legal protection and sanctions for personal data violations have been regulated in Law No. 11 of 2008 and its amendments regarding Electronic Information and Transactions, but specifically regarding legal protection and sanctions for personal data violations in online loan services have been listed in the Service Authority Regulation. Finance No.77/POJK.01/2016 concerning Information Technology-Based Borrowing-Lending Services, which is emphasized in Article 26 that the organizer is responsible for maintaining the confidentiality, integrity and availability of users' personal data and in its use must obtain approval from the owner of personal data unless specified otherwise by the provisions of laws and regulations. Sanctions for personal data violations refer to Article 47 paragraph (1), namely administrative sanctions in the form of written warnings, fines, and the obligation to pay a sum of money.
