Abstract

The Prosecutor's Office as one of the institutions of law enforcement officers to enforce the rule of law, protect the public interest, and uphold human rights is carried out through the functions of investigation and prosecution. In the case of Civil and State Administration as regulated in Article 30 Paragraph (2) of Law No. 16 of 2004 has a special power to act both inside and outside the court for and on behalf of the State or government both inside and outside the court which is the task of the Deputy Attorney General for Civil and State Administration. In Article 24 of the Regulation of the President of the Republic of Indonesia No. 38 of 2010 concerning the Organization and Work Procedure of the Prosecutor's Office of the Republic of Indonesia, it is stated that the Deputy Attorney General for Civil and State Administration is an auxiliary element of the leadership in carrying out the duties and authorities of the Prosecutor's Office in the Civil and State Administration sector. In the Presidential Regulation of the Republic of Indonesia No. 38 of 2010 and the Attorney General's Regulation No. Per- 025/A/JA/11/2015 concerning guidelines for the implementation of Law Enforcement, Legal Aid, Legal Considerations, Other Legal Actions and Legal Services in the Civil and Administrative Sector. Departing from the problems above, there are several questions: How is the implementation of the duties and authorities and what factors are the obstacles in carrying out the duties and authorities of the Sidoarjo District Attorney in the Civil and State Administration?. This research is empirical. The type of data used is primary data consisting of interviews and secondary data which includes primary legal materials, secondary legal materials and tertiary legal materials. The data collected was then analyzed through a qualitative descriptive analysis with the result that the Sidoarjo District Attorney has made every effort to carry out its duties in 2019-2021 and has handled various handling of Civil and State Administrative cases in the Civil and State Administration, which are divided into 2 categories. namely in the form of Legal Assistance and also legal assistance in litigation and non-litigation to represent related parties (Local Government, BPJS, BUMD/N) to protect and restore rights, and in carrying out their duties in the Civil and Administrative fields at the Prosecutor's Office. The country of Sidoarjo received a number of obstacles and support. The inhibiting factors are internal factors, namely inadequate Human Resources (HR), and external factors, legal cultural constraints and insufficient budget.
