Abstract

Technological developments bring changes in various aspects of human life. The development of the benefits of the internet as a means of social interaction has provided many conveniences for communicating and accessing information in all fields. Especially in the business world that is currently facing intense global competition. Currently the use of the internet is one of the factors for business people in an effort to improve their business, for example, such as the online transportation service business. When online transportation has become rampant, applicator companies have begun to compete by offering the cheapest rates to attract customers. In the absence of tariffs offered, the income of online transportation partners becomes inhumane. Even though there are clear regulations regarding online transportation costs, it turns out that Gojek and Grab have violated the regulations that they themselves agreed to. Partners complain that rates are getting lower and not in accordance with applicable laws. The research method used is normative research using normative case studies in the form of legal behavior products. The general objectives of this research are divided into 2, namely; 1) To find out what are the regulations regarding online transportation that apply in Indonesia. 2) To find out the steps for law enforcement against online transportation in Indonesia. The results of the study show, 1) The use of KP 564 of 2022 rules is still not effective, marked by demonstrations by online transportation drivers. 2) The government's role is considered minimal in imposing sanctions on applicator companies that do not follow the rules. The conclusion that can be drawn is that the use of criminal law in resolving online transportation tariff disputes should have been carried out as one of the government's commitments in carrying out its work, namely to realize a sense of justice, legal certainty, and benefits in society.
