Abstract
The research aim to knows the punishment in deciding cases of criminal acts of narcotics abuse by members of the national police and what the obstacles faced in the investigation process against members of the police who commit criminal acts of narcotics abuse. The research includes normative juridical research with descriptive research type where in this study will describe how the implementation of legal action against police officers who commit criminal acts of narcotics abuse are reviewed according to Law Number 35 of 2009 Concering narcotics.Sources of data in writing this study using field library research as well as secondary data and primary data using qualitative data analysis. Based on the discussion, it can b concluded that law enforcement officers are indicated for criminal cases substance abuse is in comformity with the legalization in force, in which the enforcement process is done at the level of both the police (the investigation stage), level attorney (prosecution stage) reached the level of the judiciary (judges decision), the same as if the overall crime drug abuse public. That all men equal before the law, even the lav enforcement officers that the suspect is the imposition of criminal can be more severe. Suspect it is the law enforcement officers who should run the command position to fight narcotics, but he was involved in criminal cases drug abuse. Legal proceddings against the police officers who commit criminal acts are in accordance with article 29 paragraph (1) of act No. 2 of 2002 on the Indonesian National Police. The process of the enforcement of the code of professional conduct of members of the police who police caught the criminal cases substance abuse is still not implemented as much as possible where the police did not immediately take action against members of the tangled case of criminal abuse of narcotics, as if the police are still protecting it is members and considered after members had be tried in a general court and found guilty of having committed the criminal narcotics.
