Abstract

This study aims to examine the protection of the object of mortgage and its execution. The problem is focused on how positive law, especially the object of mortgage in Indonesia, protects the subject and object of mortgage as well as in the event of a default until execution. The method used in this research method is normative or doctrinal legal research. The data collected through a literature approach and analyzed qualitatively through a literature study found one of which was the need for a renewal of the guarantee law arrangement with the aim that the mortgage law had the right position and frame in the civil law system in Indonesia.
